1. Acceptance of Terms
By accessing the Services, creating an account, submitting a booking, ticking acceptance boxes, typing a digital signature, or joining an expedition, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are booking for another person, you confirm you have authority to bind them; both you and that person are jointly responsible for compliance.
We may update these Terms at any time. The “Last updated” date will change when we do. Continued use after changes constitutes acceptance where permitted by law. If you do not agree, you must stop using the Services and cancel pending bookings according to the cancellation policy.
2. Eligibility & fitness
- You must be at least 18 years old (or the legal age of majority in your jurisdiction, if higher) and legally competent to enter contracts.
- You must hold a valid motorcycle licence appropriate for the motorcycle class and jurisdictions of the tour, plus any international permits required.
- You represent that you are medically and physically fit for long-distance motorcycle travel, altitude, climate, and the terrain described for your tour, and that you have disclosed material medical conditions that may affect safety.
- We may require a skills assessment, experience verification, or fitness declaration. We may refuse or cancel participation if we reasonably believe you are unfit, underqualified, intoxicated, or a safety risk.
3. Accounts & portal use
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep documents current. You must not misuse the portal, attempt unauthorised access, upload malware, scrape the site, or interfere with other users or systems. We may suspend or terminate accounts for breach, fraud, abuse, or safety reasons.
4. Bookings, deposits & payments
- A booking request is an offer to purchase. A booking is confirmed only when we accept it and any required deposit is received (or as otherwise confirmed in writing by GeoMoto).
- Prices, inclusions, exclusions, itineraries, bike models, hotels, and dates on the website are indicative and may change. The confirmation and tour brief control the commercial terms for your expedition.
- Deposits and balances are due as stated in your booking confirmation. Late payment may result in cancellation without refund beyond what the cancellation schedule allows.
- Taxes, payment gateway fees, currency conversion, wire charges, and third-party surcharges may apply and are your responsibility unless expressly included.
- You authorise us and our payment processors to charge amounts you approve. Disputed charges do not waive amounts properly owed under these Terms.
5. Cancellation, changes & refunds
Unless a specific tour confirmation states otherwise, the following default schedule applies to customer-initiated cancellations (percentages refer to tour price paid, less non-recoverable third-party costs already incurred):
| Timing before departure | Refund |
|---|---|
| 90+ days | Full refund minus admin fee (as stated at booking; if unspecified, INR 20,000 / EUR 200 equivalent) |
| 60–89 days | 50% refund |
| 30–59 days | 25% refund |
| Within 30 days | No refund |
- Transfer to another qualified rider or a future GeoMoto date may be allowed at our discretion, subject to fees and availability.
- No-shows, late arrivals, visa refusals due to your documentation, or withdrawal for personal reasons after departure are non-refundable.
- If GeoMoto cancels a tour for reasons within our reasonable control (other than force majeure), you may choose a transfer to another date/tour or a refund of amounts paid for undelivered services, less irrecoverable third-party costs we disclose.
- Refund timelines depend on banks and payment providers and may take several business days or longer.
6. Rider obligations
You agree to:
- obey all traffic laws, local regulations, guide instructions, and safety briefings;
- wear appropriate protective gear (helmet and riding gear meeting tour standards);
- ride within your ability; do not ride under the influence of alcohol, drugs, or impairing medication;
- secure required visas, vaccinations, travel documents, and foreign exchange in time;
- upload requested documents by deadlines and ensure they are genuine and valid;
- treat staff, partners, and other riders respectfully;
- report incidents, damage, or medical issues promptly;
- not engage in reckless riding, stunts, racing, or off-route travel without guide approval.
Breach may result in immediate removal from the tour without refund, and you remain responsible for return travel and related costs.
7. Motorcycles, gear & property
- Motorcycles may be owned by GeoMoto, rented, or sourced from partners. Assignment is based on availability, fit, and route needs and is not guaranteed to a specific make/model unless confirmed in writing.
- You must inspect the motorcycle at handover and report defects immediately. Continued use after handover constitutes acceptance of visible condition, subject to latent defects we reasonably should have known.
- You are responsible for damage caused by misuse, negligence, racing, intoxication, unauthorised riders, confiscation, fines, tolls, parking, and loss of keys/accessories, to the extent not covered by applicable insurance after deductibles.
- Security deposits or holds may be required. Personal belongings remain your responsibility at all times.
- If you ride your own motorcycle, you remain solely responsible for its roadworthiness, insurance, shipping, customs, and mechanical issues.
8. Insurance (mandatory)
You must obtain and maintain comprehensive travel and motorcycle-related insurance covering medical treatment, emergency evacuation/repatriation, personal accident, trip cancellation/interruption, and third-party liability as appropriate for the destinations. Proof may be required before departure. GeoMoto does not act as your insurer. Gaps in coverage are solely your risk.
9. Assumption of risk
You understand and voluntarily accept that motorcycle expedition touring includes risks arising from, among other things: traffic and road conditions; weather; altitude; wildlife; remoteness; mechanical failure; other riders and road users; navigation errors; lodging and food; medical unavailability; political unrest; crime; and acts of nature. Outcomes may include property damage, injury, permanent disability, or death.
You participate voluntarily and assume all such risks, whether or not described above, and whether caused in whole or part by the negligence of GeoMoto or others, to the maximum extent permitted by applicable law.
10. Release & waiver of liability
To the maximum extent permitted by law, you (for yourself and your heirs, executors, insurers, and assigns) release and forever discharge GeoMoto and its owner(s), officers, employees, contractors, guides, lead riders, partners, suppliers, agents, and affiliates (the “Released Parties”) from any and all claims, demands, actions, and liabilities arising out of or related to the Services or your participation, including claims based on negligence, except to the extent caused by a Released Party’s wilful misconduct or fraud, or where such release is prohibited by law.
This release covers bodily injury, death, property damage, emotional distress, economic loss, and consequential damages arising before, during, or after an expedition, including travel to/from meeting points.
11. Indemnification
You agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, damages, losses, fines, costs, and expenses (including reasonable legal fees) arising out of or related to:
- your breach of these Terms or applicable law;
- your negligence, recklessness, or wilful misconduct;
- injury or damage you cause to third parties, other riders, staff, or property;
- inaccurate documents, false representations, or unauthorised sharing of another person’s data;
- your failure to obtain required insurance, licences, visas, or medical clearance;
- disputes between you and third-party providers where GeoMoto acted as facilitator;
- taxes, penalties, or assessments attributable to you.
GeoMoto may assume exclusive defence of any matter subject to indemnification; you will cooperate fully and not settle any claim admitting fault of a Released Party without our prior written consent.
12. Limitation of liability
To the maximum extent permitted by law:
- the Services and all itineraries, advice, content, and logistics are provided on an “as is” and “as available” basis;
- GeoMoto is not liable for indirect, incidental, special, punitive, or consequential damages, lost profits, lost data, or business interruption;
- GeoMoto’s total aggregate liability for any claim relating to the Services or a booking shall not exceed the amounts you actually paid to GeoMoto for the specific tour giving rise to the claim in the 12 months preceding the event;
- nothing in these Terms excludes liability that cannot be excluded under applicable law (including certain liability for death or personal injury caused by negligence where such exclusion is void).
13. Third-party services
Expeditions rely on independent third parties (hotels, airlines, ferry operators, motorcycle lessors, restaurants, local agents, payment processors, map/data providers). GeoMoto is not liable for their acts, omissions, insolvency, standards, or schedule changes, except to the extent required by non-waivable law. Your use of third-party services may be subject to their own terms.
14. Photos, video & testimonials
You grant GeoMoto a worldwide, royalty-free, perpetual licence to use photographs, video, and audio capturing you during expeditions for legitimate business purposes (portfolio, website, social media, marketing), unless you provide a written opt-out before departure and we confirm it in writing. Opt-out may not be feasible for group background imagery. You will not use GeoMoto branding or private rider data for commercial purposes without permission.
15. Intellectual property
All GeoMoto names, logos, designs, text, software, itineraries, and content are owned by GeoMoto or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the website for personal, non-commercial purposes. You may not copy, scrape, reverse engineer, or exploit our content or systems except as allowed by law.
16. Conduct, safety authority & removal
Guides and GeoMoto staff have final authority on safety decisions, routing, pacing, and weather calls. We may modify, delay, or terminate activities when reasonably necessary. We may remove any participant who endangers others, refuses instructions, harasses others, or breaches these Terms, without refund, and you remain responsible for onward travel costs.
17. Force majeure & itinerary changes
GeoMoto is not liable for failure or delay caused by events beyond reasonable control, including natural disasters, extreme weather, epidemics, government actions, war, terrorism, strikes, civil unrest, border closures, supplier failure, or infrastructure collapse. In such cases we may alter routes, lodging, bikes, or dates; refunds, if any, are limited to recoveries we actually obtain from suppliers after reasonable efforts.
18. Website & advice disclaimers
Website content is for general information and does not constitute professional legal, medical, or travel advice. We do not warrant uninterrupted or error-free operation of the site, dashboards, or notifications. Links to third-party sites are provided for convenience only.
19. Governing law & disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any non-waivable consumer rights, courts in Bengaluru (Bangalore), Karnataka, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.
Before filing a claim, you agree to attempt good-faith resolution by contacting us with a written description of the dispute and allowing thirty (30) days to respond.
20. General provisions
- Entire agreement: These Terms, the Privacy Policy, and your booking confirmation constitute the entire agreement regarding the Services and supersede prior discussions, except for any signed liability forms we may require at departure.
- Severability: If any provision is held unenforceable, the remainder continues in effect, and the provision shall be modified to the minimum extent necessary to make it enforceable.
- No waiver: Failure to enforce a provision is not a waiver of future enforcement.
- Assignment: You may not assign your booking without our consent. We may assign these Terms to an affiliate or successor.
- Language: English controls if translations conflict.
- Notices: We may notify you via email, portal message, SMS, or push notification to contacts associated with your account.
